These Terms may be revised from time to time without notice; the revised Terms take effect when posted on the website. If you do not agree to them, please do not use the website or its services.
In these Terms and Conditions, the following definitions apply:
2.1. “Buyer” (Client / Customer / You / Your) means the person or entity purchasing goods or services from Lyv Pharmacy.
2.2. “Goods” / “Products / Services” means the goods or services set out in the order, including any replacements, substitutions, or additions.
2.3. “Supplier” / “Lyv Pharmacy” / “We / Us / Our / Seller” means Lyv Pharmacy [Lyv Limited.; 4th Floor, 95 Gresham Street, London, EC2V 7AB]
2.4. “Conditions” means these standard terms and conditions and any special terms agreed in writing.
2.5. “Contract” / “Agreement / Order” means the contract between the Buyer and Lyv Pharmacy for the purchase and sale of the Goods under these Terms.
2.6. “Writing” includes letters, email, facsimile, and comparable communications.
2.7. “Terms” means these Terms & Conditions (as updated from time to time).
3.1. These Terms apply to all Contracts for the supply of Goods and Services by Lyv Pharmacy to the Buyer.
3.2. Any additional or different terms you try to impose (e.g. in your purchase order) will not apply unless expressly agreed in writing by Lyv Pharmacy.
3.3. We will use reasonable endeavours to complete services on schedule, but time is not of the essence unless expressly agreed in writing.
3.4. Accepting a delivery of the Goods constitutes your acceptance of these Terms.
3.5. Any contract made with you without explicit reference to these Terms (e.g. via email) will still be deemed subject to these Terms.
4.1. Your Order constitutes an offer by you to purchase the Goods under these Terms. You are responsible for ensuring your order is accurate and complete.
4.2. An Order is only accepted when Lyv Pharmacy indicates acceptance (in writing), at which point the Contract commences.
4.3. Lyv Pharmacy may accept orders via email, post, online platform, prescriptions, or other writing.
4.4. Orders accepted by Lyv Pharmacy will always be subject to these Terms.
4.5. Prescription goods are intended only for the patient named in the prescription.
4.6. Prescription dispensing must comply with applicable regulatory requirements in the United Kingdom, which may include but are not limited to recommendations from the MHRA, CQC, GMC, GPhC and other relevant bodies.
4.7. Payment must be completed using approved online payment providers (e.g., card, Apple Pay, Google Pay).
4.8. Order confirmation is generated automatically - this does NOT guarantee prescription approval.
4.9. For prescription items, approval depends on clinician review.
5.1. All prices exclude VAT (or applicable sales tax) unless stated; Buyer is liable to pay such tax.
5.2. Prices are confirmed at Order time but may vary due to exchange rates, inflation, or cost variations.
5.3. Payment is due in full when the Order is processed, unless otherwise agreed in writing.
5.4. Lyv Pharmacy reserves the right to withdraw any discounts or promotional rates.
5.5. If recurring payments fail, we will attempt again. Subscription may be paused or cancelled if unresolved.
6.1. Confirmed delivery dates are approximate; Lyv Pharmacy is not liable for delay unless expressly agreed.
6.2. On delivery, Buyer must check the courier documentation and notify Lyv Pharmacy within 48 hours of any missing items.
6.3. Once Goods are dispatched and in transit, Lyv Pharmacy is not liable for supplier or courier delays; Buyer cannot refuse acceptance due to late delivery.
6.4. Buyer should give courier instructions if not available to accept delivery; Lyv Pharmacy is not liable for missed deliveries post-dispatch.
6.5. Deliveries may be left in a safe place if authorised by the customer.
6.6. We are not responsible for delays caused by courier strikes, severe weather, or external factors.
6.7. If delivery fails, the courier will attempt redelivery or provide collection instructions.
7.1. You may cancel orders by following the instructions for cancellations on the website or by notifying us via phone (if applicable).
7.2. You must return goods securely and in good condition. Lyv Pharmacy will not accept returns for:
7.3. If a wrong/damaged item is delivered (non-cold chain), you must notify Lyv Pharmacy in writing within 24 hours of receipt. Return it in original packaging (unopened) within 3 days. Cold chain goods must be returned within 24 hours.
7.4. Lyv Pharmacy reserves the right to inspect returns and refuse invalid ones.
7.5. Lyv Pharmacy will not refund items lost or damaged in transit back to Lyv Pharmacy if the fault lies with the buyer’s shipping.
7.6. Prescription products cannot be returned once dispatched (legal requirement).
7.7. You have the right to cancel non-prescription products within 14 days (Consumer Contracts Regulations).
7.8. Refunds for returned items will be processed within 7–14 days.
8.1. Lyv Pharmacy warrants Goods will be of satisfactory quality (subject to statutory rights).
All other implied warranties, representations or conditions are excluded to the fullest extent allowed by law.
8.2. Except for death or personal injury caused by negligence (which cannot be limited), Lyv Pharmacy’s liability is capped at the price paid for the specific Goods.
9.1. All prescriptions must be complete, with express patient consent and contact details.
9.2. Prescription Goods are for the named patient only and not for resale.
9.3. Prescription will be delivered to the address nominated by the patient.
9.4. Prescription dispensing must comply with applicable law and remote / telehealth rules in the UK.
9.5. In the case of prescription products, Lyv Pharmacy may use third-party partner pharmacies or prescribers. The contract for prescription goods may be directly between the patient/buyer and the pharmacy.
9.6. Clinicians may refuse, modify, or cancel prescriptions at their discretion based on medical assessment.
9.7. We may cancel orders flagged as suspicious or requiring ID verification.
10.1. To use certain Services, you must create an Account and provide accurate personal, health, payment and contact details.
10.2. You must be at least 18 years old to use this website or purchase products.
10.3. You are responsible for account security and monitoring access.
10.4. Lyv Pharmacy may suspend or terminate accounts at its discretion.
10.5. If Lyv Pharmacy offers consultations/prescriptions (or telehealth), you may be required to complete intake forms and authorise data sharing for clinical review.
10.6. Prescription products may only be dispensed post-clinician review and approval.
10.7. Some products may be offered via subscription: by ordering, you agree to recurring billing. You may cancel the subscription, subject to terms (e.g. notice period).
10.8. Prescription must typically be renewed periodically (e.g. every 12 months) to remain eligible.
10.9. Lyv Pharmacy may suspend or terminate the subscription if the prescription is outdated, payment fails, stock is unavailable, or information is not updated.
10.10. Payment methods for Services must be valid and acceptable to Lyv Pharmacy. Lyv Pharmacy may refuse payment or suspend Services if verification fails.
10.11. If payment fails and is not rectified within a defined period (e.g. 7 days), Lyv Pharmacy may suspend or terminate access to Services.
10.12. If any Services or goods are unavailable, Lyv Pharmacy will inform you and refund applicable sums.
10.13. Lyv Pharmacy may refuse or decline orders at its discretion.
11.1. Lyv Pharmacy will deliver only after approval (if required) and after payment is processed.
11.2. Delivery cost will be shown on the website or during checkout.
11.3. Lyv Pharmacy (or partner pharmacy) is not liable for delays due to external factors (force majeure).
11.4. If a substantial delay (> 1 week) arises, you may cancel and receive a refund for undelivered goods.
11.5. If delivery fails because your address is unavailable, the courier may leave a notice; you may need to reschedule.
11.6. For non-delivery after dispatch, you have 7 days from the shipment date to request a replacement; after that, Lyv Pharmacy may refuse.
11.7. Product orders depend on availability. If a product is out of stock or unavailable, Lyv Pharmacy will notify you and refund you.
11.8. Lyv Pharmacy may suspend supply for technical, regulatory, or upgrade reasons. If suspension > 1 month, adjust billing or refund.
11.9. Lyv Pharmacy may suspend supply if you are in non-payment or in breach.
12.1. For non-prescription products, you may cancel within 14 days of delivery without reason (if permitted by local law). Notify Lyv Pharmacy via email. Return product within 14 days at your cost.
12.2. For prescription products, no returns for safety & regulatory reasons (unless error by Lyv Pharmacy).
12.3. If goods are defective, faulty, or mis-described, return costs will be borne by Lyv Pharmacy.
12.4. Refunds are made via the original payment method. Lyv Pharmacy may withhold until inspection or proof of return.
12.5. Lyv Pharmacy may deduct from the refund for loss in value due to misuse or handling beyond what’s allowed.
13.1. You may not use the website or services for commercial purposes unless expressly permitted.
13.2. You must not interfere with website security, reverse engineer software, impersonate others, post harmful content, or violate laws.
13.3. All content, IP, and trademarks on the site remain Lyv Pharmacy’s (or licensors’) property. Use is permitted only for personal use under these Terms.
13.4. Lyv Pharmacy may use ideas, feedback, or suggestions you submit without compensation.
14.1. The website, services, and products (unless otherwise stated) are provided “as is”, without warranties.
14.2. Lyv Pharmacy disclaims all implied warranties (merchantability, fitness for purpose, non-infringement) to the maximum permitted by law.
14.3. Lyv Pharmacy is not liable for use of site content, interrupted access, software incompatibility, or external links.
14.4. Lyv Pharmacy does not offer medical advice; content is not a substitute for professional clinical consultation.
14.5. Lyv Pharmacy does not guarantee the site will always work or is free of viruses or malware.
15.1. These Terms and communications shall be in English.
15.2. You may not assign your rights under these Terms. Lyv Pharmacy may assign its rights or delegate performance.
15.3. No third-party rights: only you and Lyv Pharmacy have rights under the contract.
15.4. If any clause is found invalid, the rest remain in force.
15.5. Delay or forbearance in enforcing rights does not constitute waiver.
15.6. UK Law governs these Terms.
15.7. In the event of dispute, first contact Lyv Pharmacy support to attempt informal resolution; if unresolved, mediation or arbitration may be used.
15.8. Our processing of your data is governed by our Privacy Policy. By using the service, you consent to this processing.
