These Pharmacy Terms (“Pharmacy Terms”) govern the fulfilment of prescriptions for products (“The Products”) by Mediva Pharmacy, registered at 54, Tanners Drive Blakelands, Milton Keynes MK14 5BP, Buckinghamshire, United Kingdom. Registration Number GPHC 9010928 (the “Pharmacy”).
When you order prescription Products via LYV Pharmacy, your contractual relationship for those Products is directly with the Pharmacy.
The Pharmacy will dispense the Products only upon receipt of a valid prescription issued by a licensed prescriber, based on a personal consultation and assessment.
We will only fulfil the prescription if the Pharmacy approves it.
Payment or settlement for The Products must be received or arranged before dispensing.
You confirm that the information given to the clinic or prescriber is complete and accurate, and you consent to sharing your health / prescription data with the Pharmacy and relevant parties. If you withdraw that consent, you must notify us immediately.
If your relationship with the referring clinic is terminated, the Pharmacy Terms may also be terminated, and dispensing may cease.
Once your valid prescription is accepted, we will dispatch The Products promptly. You will receive an order confirmation email with details.
If you do not receive The Products within 30 working days of confirmation, inform us so we can investigate.
Title to The Products transfers to you when they leave the Pharmacy’s premises.
The Pharmacy is not liable for damage in transit, or delays or failures caused by circumstances beyond its control (e.g. postal / courier issues, backorders).
The Pharmacy does not accept returns of The Products except when: • They were dispensed in error (i.e. do not match your prescription).
If an error occurs, you must notify us promptly for remedy (such as replacement).
All returns must be handled in accordance with applicable regulatory rules and safely, ensuring no risk from partial / used products.
You must read the Patient Information Leaflet Accompanying The Products prior to use.
You are responsible for using The Products in accordance with directions and only for your prescribed condition. The Products must not be shared with any other person.
You must notify your GP or primary care provider of your use of The Products.
To the maximum extent permitted by law, the Pharmacy disclaims all express or implied warranties (including fitness for purpose or merchantability).
Your sole remedy for claims relating to The Products is a like-for-like replacement (if valid under error conditions).
The Pharmacy is not responsible for any indirect, incidental, or consequential losses arising from use or access to The Products.
You may not assign your rights or obligations under these Pharmacy Terms.
The Pharmacy may assign or license its rights or obligations at its discretion.
Delay in enforcing any right does not waive that right.
The Pharmacy reserves the right to modify these Pharmacy Terms from time to time. Changes will become effective when posted.
These Pharmacy Terms and any disputes arising under them are governed by English law, and subject to the exclusive jurisdiction of the English courts.
